Welcome to Nyx Web Designs. By accessing or using our website and services, you agree to be bound by the following terms and conditions. Please read these terms carefully before proceeding.

2. Services Provided

• Web Design & Development

We provide professional web design and development services tailored to meet the client’s specific needs. Deliverables include custom designs, responsive functionality, and agreed-upon features as outlined in the project proposal or agreement.

• Domain & Hosting Services

We offer reliable website hosting for an additional fee, with the first year included in certain packages. Hosting is subject to periodic renewal, and clients will be notified in advance of expiration dates. As part of our hosting and setup services, we assist with domain registration and renewal. The cost of domain services is included in specific packages or billed separately.

• Website Maintenance & Support

Our Nyx Care plan covers updates, backups, minor edits, speed optimization and general maintenance to ensure the website remains secure, functional, and up-to-date. This is available as a monthly or annual subscription.

• Search Engine Optimization (SEO)

We provide SEO services to improve your website’s search engine visibility. These services are part of ongoing monthly packages and require consistent collaboration for optimal results.

• Additional Services

We offer add-ons such as chatbot integration, advanced analytics, lead generation tools, and e-commerce functionality. All additional services will be outlined and billed separately.

3. Payments Terms

• Website Design & Development (One-Time Projects)

  – A 50% upfront payment is required before work begins.

  – The remaining 50% balance is due upon project completion and approval.
  
  

• Ongoing Services

  – Services such as website maintenance (Nyx Care), SEO, and hosting are billed monthly or annually.

  – All recurring payments must be made on or before the due date specified on the invoice.

  – Failure to make timely payments may result in suspension of services until payment is received.
  
  

• Refund Policy

  – The 50% upfront payment is non-refundable once work has begun, as it covers time, planning, and initial resources allocated to the project.

  – Once a project has been delivered, no refunds will be issued.

  – Payments for ongoing services are non-refundable once the billing period has started.

  – Clients may cancel recurring services with a 7-day written notice. Services will cease at the end of the current billing cycle.

4. Confidentiality and Security

• Nyx Web Designs agrees to keep all login details, passwords, and sensitive information provided by the client confidential and secure.
• Nyx Web Designs will not share or disclose any confidential information to third parties without the client’s written consent.
• We take all reasonable precautions to ensure the security of the client’s information and website.

5. Responsibility

• Nyx Web Designs is not responsible for changes made to the website by the client or any third party after project delivery.

• Nyx Web Designs is not responsible for any Loss of data, website downtime, or disruptions caused by third-party providers or hosting platforms.

• Clients are solely responsible for ensuring they have the rights to all content (images, text, videos, etc.) provided to us. Nyx Web Designs is not liable for any copyrighted materials supplied by the client or for edits made after delivery

6. Ownership and Rights

• Intellectual Property: Upon completion and full payment, ownership rights to the final website design are transferred to the client.
• Third-Party Materials: We may use third-party plugins, fonts, or images. Clients are responsible for ensuring compliance with any licenses or terms associated with these materials.
